If We Divorce, Do I Get A Portion Of My Spouse’S Retirement?

Retirement benefits are similar to any other asset. If the benefit was earned during the marriage, or even a part of it, then that portion is considered community property.

The court may divide a spouse’s retirement after taking into consideration all other assets, both community and separate, and making an equitable division.
